Arbitration
In arbitration, the parties opt out of a court trial in favor of having the issues decided privately by a mutually agreed upon arbitrator. Arbitration offers many clear advantages. Importantly, it allows the parties to address their finances and personal issues privately rather than on the record in a courtroom which is open to the public. It also gives the parties substantial control over the process. The most significant aspect of this control is the ability to decide who will hear the case. Rather than arriving in the courthouse and being randomly assigned to a judge, the parties are able to select an arbitrator with the background and experience their case requires.

Arbitration also gives the parties greater control over scheduling and the protocols that will govern the proceedings. This would include such issues as where and when the arbitration takes place and when each arbitration day begins and ends. With greater control, the parties are typically able to navigate the process more efficiently and with less expense than would be expected with the traditional court process.
